Four Drug Felonies Dismissed

A client of Jurach, Tacey & Quitiquit was charged with four counts of violating §18.2-248Distribution of a Schedule I/II drug, in Henrico County.  The allegations claimed our client had distributed Heroin, a Schedule I drug.  Conviction of these charges would have had very serious implications for our client.  Conviction for §18.2-248, Distribution of a Schedule I/II drug, would result in a felony record, loss of license, and fines among other things.  Additionally, conviction would have resulted in lengthy mandatory prison sentences, due to the nature of the charges, and our client’s criminal record.  The case was set for a two day jury trial in the Henrico Circuit Court.  Our attorneys extensively reviewed all of the evidence, and prepared for the charges our client faced.  During our preparation for trial, one of the attorney’s found an issue with the case.  Our attorney argued this issue to the Judge, and after that argument, the Assistant Commonwealth’s Attorney handling the case made a motion to nolle prosequi all of the charges against our client.
