Common Virginia Firearms Charges
There are a number of statutes that deal with firearms in Virginia. There are even more charges which have enhanced penalties if there is a firearm or weapon involved in the commission of the crime. Charges range from firearm possession, theft, use as well as many others. The most common charges that we see are:
- Possession of a Concealed Weapon (§ 18.2-308),
- This charge can be a misdemeanor of felony, and has many exceptions.
- False Statement on Firearm Application (§ 18.2-308.2:2),
- This is a very common charge. The false statement has to be both knowingly and intentionally made.
- Reckless Handling of a Firearm (§ 18.2-56.1).
- Typically, this is the result of an accidental or careless discharge of a weapon.
Each of the previously listed charges are explained in more detail on their respective pages if you want to read more about the individual charges. The previous list is not exhaustive, but examples of cases we defend on a weekly basis.
