There are a number of statutes that deal with firearms in Virginia. There are even more charges which have enhanced penalties if there is a firearm or weapon involved in the commission of the crime. Charges range from firearm possession, theft, use as well as many others. The most common charges that we see are:
- Possession of a Concealed Weapon (§ 18.2-308),
- This charge can be a misdemeanor of felony, and has many exceptions.
- Felon in Possession of Firearms (§ 18.2-308.2),
- There are differing penalties for the type of prior felony.
- False Statement on Firearm Application (§ 18.2-308.2:2),
- This is a very common charge. The false statement has to be both knowingly and intentionally made.
- Reckless Handling of a Firearm (§ 18.2-56.1).
- Typically, this is the result of an accidental or careless discharge of a weapon.
