Trespassing in Violation of §18.2-119

The definition of Trespassing in Virginia is defined §18.2-119.  In short, trespassing is going onto the land of another after you have been forbidden to. We often see people treat a trespassing charge not as seriously as other crimes.  However, trespassing is a Class 1 Misdemeanor and carries up to 12 months in jail and/or a $2500 fine.  Some common ways the charge come to us from hunters accidentally going onto others land, people asked to leave a business, among others.  The Commonwealth must prove each of the elements beyond a reasonable doubt for you to be found guilty of trespassing.
